II. General Terms of Use

Intellectual property

  1. The software ERMES is owned by the company Archimed, 49 boulevard de Strasbourg, 59042 LILLE CEDEX - SIRET 39308811700071.
  2. Software license
    The software license agreement eis the property of the Regional Council of Brittany.
  3. The website's graphic chart and stylesheets, including illustrations, are the property of the Regional Council of Brittany. Any reproduction, full or partial representation, use, adaptation, provision or modification of these materials, by any process, by anyone and by any means, without the express authorization of the Regional Council of Brittany, and potential authors or their representatives, is strictly prohibited and constitutes an infringement of copyright according to the intellectual property code.
  4. BRETANIA, BRETANIA's logo and signature « The Portal of Breton cultures » are registered trademarks in the INPI, and are, as such, protected by the intellectual property right. Any full or partial reproduction of the trademarks or logos used on the website, without the express authorization of the Regional Council of Brittany, is strictly prohibited and constitutes an infringement of copyright according to the intellectual property code.
  5. Each detailed sheet and thumbnail originating from a Portal's contributor is published under the contributor's own rights plan.
  6. Editorial contents (thematic dossiers, videos, animations, timelines, interactive map) are published under the Creative Commons license CC-BY-ND:

Personal data

Some personal data, such as, without this list being exhaustive, language, IP address, OS, country, browser and setup, can be collected while browsing the website BRETANIA.FR.

The emails sent to the BRETANIA.FR website editorial staff, and the email addresses used to send additional information are likely to be stored.

III. General Terms of Use of the service offer « My account »

Service provider

The services User has access to through the service offer « My account » on the website BRETANIA.FR are provided by the Regional Council of Brittany. Any use of the services implies that User agrees to abide by the Terms of Use contained herein.

Description of the services

The Regional Council of Brittany provides User with, among others, the possibility to have a personal account in which he/she can:

  • manage the personal information associated with their account,
  • manage a cart of favorite detailed sheets,
  • manage automatic subscriptions for pre-configured search results.

Identification obligation and conditions for membership

The use of the services previously mentioned is subject to an identification obligation. The information supplied must be true, exact, complete and up-to-date. The Regional Council of Brittany grants User with a personal, free of charge, non-sublicensable and non-exclusive license to access the service offer « My account », subject to strict compliance with the General Terms of Use contained herein, which, prior to becoming a member, User acknowledges having read and unreservedly accepted.

Provisions on personal data

The personal data filing system relating to BRETANIA.FR's User with an account provided by the service offer « My account » complies with the provisions of the amended French data protection legislation n°78-17 of 6 January 1978, « Information Technologies and Liberties ».

User, in accordance with this legislation, has the right to access, correct and object information relating to him/her. If you wish to exert this right, you may send an e-mail to the website editorial staff at the following address : contact(at)bretania.fr.

Furthermore, User can update the information relating to him/her in the service offer « My account ».

Technical general provisions

If User uses the service offer « My account » from a public place, he/she should always log out before he/she leaves such place, in order to prevent third party access to his/her account.

Accessing the service offer « My account » through any other mean than the interface provided by BRETANIA.FR is prohibited, as well as attempting to access, modify or copy the source code of the software or of the applications providing access to the website BRETANIA.FR and/or to the service offer « My account ».

The service offer « My account » may temporarily be unavailable. In such event, the Bretagne Culture Diversité staff shall do their utmost to restore access to the service as soon as possible

The Regional Council of Brittany may make modifications to the service offer, to the access conditions to the content and/or the content itself, without prior notice or compensation.

The Regional Council of Brittany may in no event be held responsible for any direct or indirect damage or injury arising from the use, modification, suspension, interruption, unavailability of all or part of the website.

Intellectual property

As part of the service offer, User expressly acknowledges that the contents offered on the website BRETANIA.FR are covered by intellectual property rights under the applicable laws and regulations.

User therefore agrees not to copy, electronically or otherwise, elements from his/her account or of any content displayed on the website BRETANIA.FR, on whatever media and by any means, free of charge or against payment, for advertising, commercial or non-commercial purposes, and outside of private circles. It should be noted that outside of private circles, any copy, made electronically or otherwise, of any content covered by the French Code of Intellectual Property, constitutes an infringement of trademark rights.

Termination

In the event of failure to comply with these terms and conditions, and specifically in the case of copyright infringement, the Regional Council of Brittany reserves the right to remove, without compensation, immediately and without prior notice, User's private online area.

Specific recommendations for foreign users

The Regional Council of Brittany allows distant access to the service offer « My account » from any country, subject to applicable local law. User connected to the service offer « My account » from an IT terminal located outside French territory expressly acknowledges having read, understood and unreservedly accepted the general terms and conditions contained herein.

Modification of the General Terms of Use

Any modification of the general terms of use contained herein is considered to have been accepted by User.
